Privacy Policy

This Policy explains how Atlantis collects, uses, shares, retains, and protects information across our websites, support portal, mobile applications, cloud services, marina platform, and connected products.

Atlantis Control Systems, LLC ("Atlantis," "we," "us," or "our") provides marine automation, connected boat lift products, mobile applications, cloud services, customer support, and marina management tools. This Privacy Policy applies when you use our websites, applications, support portal, accounts, subscriptions, connected devices, Atlantis Marina services, dealer or installer workflows, and related services (collectively, the "Services").

By using the Services, you acknowledge that Atlantis will process information as described in this Privacy Policy. If you use the Services on behalf of a marina, dealer, installer, company, property, or other organization, you represent that you are authorized to provide information to Atlantis and to allow Atlantis to process it for the purposes described here.

1. Information We Collect

We collect information that you provide directly, information generated by your use of our Services, and information from authorized dealers, installers, marinas, payment processors, app stores, and service providers.

  • Account and contact information, including name, email address, phone number, mailing or service address, account credentials, communication preferences, and support history.
  • Customer, vessel, marina, slip, reservation, billing, dealer, installer, installation, warranty, service, and document information when those details are needed to provide the Services.
  • Connected product information, including device identifiers, serial numbers, controller identifiers, configuration settings, firmware and app versions, device status, command history, diagnostic data, error logs, timestamps, connectivity status, subscription status, and warranty status.
  • Location-related information you provide or that is necessary for installation, support, device configuration, marina operations, or service records, such as a service address, marina, dock, slip, or installation location. We do not use mobile device GPS data for advertising or behavioral tracking.
  • Automatically collected technical information, including IP address, browser type, operating system, app version, device type, access times, session data, cookies, local storage, and similar technologies.
  • Communications information, including email, phone, text message, push notification, call, support ticket, consent, unsubscribe, opt-out, and preference records.
  • Privacy request information, including request type, verification details, authorized-agent information, response history, appeal history, and records needed to honor legal rights and suppression requests.
  • Payment and subscription information processed through third-party payment providers such as Stripe, Apple App Store, Google Play Store, or other authorized processors. Atlantis does not store full credit card, debit card, or banking account numbers directly.

2. Boat Lift, Controller, and Safety Data

Connected Atlantis products may generate lift-specific operational records. We use these records to operate the Services, provide remote access and account controls, support safety-related features, diagnose issues, administer subscriptions and warranties, coordinate service, improve product quality, support recalls or service bulletins, and protect users, facilities, vessels, property, and Atlantis.

  • Device and product records, including serial numbers, model, component type, accessory configuration, firmware version, provisioning status, claim tokens, ownership transfers, subscription entitlements, warranty status, and dealer or installer associations.
  • Lift and controller activity, including device state, position or sensor readings, electronic limits, calibration data, relay activity, motor direction, AUX outputs, command requests, command results, failures, timestamps, user or account identifiers, and audit logs.
  • Fault, diagnostic, and safety-related records, including motor stall, low voltage, power loss, key-switch, limit, out-of-bounds, memory, connectivity, firmware-update, service, and maintenance events.
  • Access and assignment records, including shared-device grants, renter or marina-managed lift access, staff permissions, customer assignments, notification preferences, and revocation history.
  • Installation, site, service, and vessel context, including service address, marina, dock, slip, equipment photos or videos, support notes, wiring or enclosure details, maintenance history, and warranty or service-claim documentation.

3. How We Use Information

  • Provide, operate, secure, maintain, and improve the Services.
  • Create and manage accounts, subscriptions, warranty records, service records, marina records, support requests, and customer communications.
  • Enable device connectivity, remote access features, diagnostics, firmware support, notifications, billing, and customer support.
  • Coordinate authorized dealer, installer, marina, manufacturer, warranty, and service-provider workflows.
  • Analyze system health, reliability, usage, performance, and product quality, including through aggregated or deidentified data.
  • Send transactional messages by email, text message, phone, push notification, in-app message, or similar methods about accounts, orders, subscriptions, billing, service, safety, warranty, product updates, security, and support.
  • Send marketing, promotional, referral, partner, dealer, marina, targeted advertising, analytics, or business-development messages only where permitted by law and subject to available consent, unsubscribe, and opt-out rights.
  • Detect, investigate, and prevent fraud, abuse, security incidents, policy violations, and unsafe or unauthorized use.
  • Comply with legal obligations, enforce agreements, protect rights and safety, and respond to lawful requests.

4. Business and Facility Customer Data

When a marina, dealer, installer, facility operator, property manager, or other business customer uses Atlantis Marina or related Services for business operations, Atlantis may process business contact, staff, customer, vessel, slip, reservation, billing, document, agreement, message, facility, access, camera, audit, support, and operational data on behalf of or in coordination with that customer.

Facility and business customers are responsible for providing their own notices, obtaining required consents or authorizations, maintaining a lawful basis for the information they submit or instruct Atlantis to process, and complying with laws that apply to their customers, staff, contractors, guests, facilities, communications, payments, cameras, and records. Atlantis may also use business customer data as needed to provide, secure, support, improve, bill for, and enforce the Services, and as otherwise described in this Policy or an applicable written agreement.

5. Cookies, Analytics, and Local Storage

We may use cookies, local storage, pixels, log files, and similar technologies to keep users signed in, remember preferences, secure accounts, operate the website and applications, measure performance, understand aggregate usage, and improve reliability.

You can control many cookies through your browser or device settings. If you disable essential cookies or local storage, some account, checkout, support, or app features may not work correctly. Nonessential analytics should be configured so that declining cookies disables the applicable analytics collection where technically supported.

Where required by applicable law and technically feasible, Atlantis will honor legally required browser-based opt-out preference signals for sale, sharing, or targeted advertising. Because browser and device settings vary, users may also contact Atlantis directly using the opt-out methods described below.

6. How We Share Information

We share information as needed to operate the Services, support customers, communicate with users, advertise or market where permitted, measure performance, comply with law, protect safety, complete business transactions, and support the other purposes described in this Policy.

  • Service providers, including cloud hosting, database, storage, analytics, email, SMS, push notification, support, security, and application infrastructure providers.
  • Payment and app-store providers, including Stripe, Apple, Google, and other authorized payment processors, for billing, subscription, refund, tax, chargeback, and payment support.
  • Authorized dealers, installers, technicians, manufacturers, and participating lift manufacturers when needed for installation, support, diagnostics, command-history review, warranty claims, recalls, product quality, service bulletins, safety notices, and service coordination.
  • Marinas, facility operators, property managers, and authorized staff when you use Atlantis Marina, marina-managed lift access, reservations, payments, documents, messaging, or facility services.
  • Advertising, analytics, marketing, lead-generation, referral, integration, and business-development partners, where permitted by law and subject to applicable opt-out rights.
  • Business transaction recipients in connection with a merger, acquisition, financing, reorganization, bankruptcy, asset sale, or similar business transaction.
  • Law enforcement, regulators, courts, professional advisers, and other parties where disclosure is required by law or reasonably necessary to protect rights, safety, security, or property.

7. Sale, Sharing, Advertising, and Opt-Out Rights

Some privacy laws define "sale" or "sharing" broadly. A disclosure may be considered a sale or sharing of personal information even when no money is exchanged, such as when information is made available for advertising, analytics, lead generation, referrals, business development, integrations, or cross-context behavioral advertising.

Atlantis may disclose, make available, transfer, sell, or share certain categories of personal information for commercial purposes, including identifiers, contact information, commercial information, internet or device activity, approximate location, preferences, and inferences, where permitted by law. Atlantis will not knowingly sell or share personal information of children under 16, and Atlantis will sell or share sensitive personal information only after providing any required notice and obtaining any consent required by law. Mobile phone numbers and other mobile information collected for SMS or text messaging, together with text-messaging opt-in data and consent, are excluded from these categories and are never sold or shared with any third party or affiliate for marketing or promotional purposes.

Atlantis does not sell full payment card numbers. Atlantis also does not sell account passwords, authentication secrets, raw device control credentials, or raw safety-critical command credentials for advertising purposes.

The categories of third parties involved may include advertising networks, analytics providers, marketing providers, referral sources, lead-generation partners, authorized dealers, participating marinas, integration partners, business-development partners, and service providers that support these activities.

You may opt out of the sale or sharing of your personal information, targeted advertising, or applicable profiling by contacting help@atlantiscontrolsystems.com with the subject line "Privacy Opt-Out" or by using any "Your Privacy Choices" or "Do Not Sell or Share My Personal Information" link we provide. An authorized agent may submit a request for you where permitted by law. We may need to verify your identity, residency, or the agent's authority before processing a request.

Opting out does not restrict disclosures needed to provide the Services, process payments, maintain security, comply with law, complete transactions, support warranties, coordinate authorized service, perform analytics that are not legally treated as sale or sharing, or work with service providers acting on our behalf.

8. Email, Text Messages, Calls, and Contact Preferences

Mobile information, including phone numbers collected for SMS or text messaging, and text-messaging opt-in data and consent, will not be shared with or sold to any third parties or affiliates for marketing or promotional purposes. Atlantis shares this information only with service providers that help operate the messaging program, such as our SMS delivery provider, solely to deliver the messages you request, and as required by law. This applies regardless of any other sharing or sale described elsewhere in this Policy.

Atlantis may contact you by email, phone, text message, push notification, in-app message, postal mail, or similar methods for transactional, relationship, operational, security, billing, warranty, service, support, safety, product-update, and account purposes.

Marketing emails will include an unsubscribe method and any physical postal address required by law. Atlantis will honor marketing email opt-out requests within legally required timeframes. Marketing email unsubscribe applies to marketing email only; it does not unsubscribe you from transactional, relationship, safety, security, billing, warranty, service, legal, account, or operational emails.

Available system, operational, account, facility, staff, and customer notification preferences may be adjusted in the applicable account, staff, customer, or facility settings. Some transactional or relationship communications may remain required for safety, security, billing, legal, account, warranty, service, or platform-operation purposes.

Marketing text messages will be sent only where permitted by law and based on prior express written consent or other consent required by applicable law. Consent to receive marketing text messages is not a condition of purchasing goods or services. Message frequency varies, and message and data rates may apply. You may reply HELP for help. SMS and text-message preferences may be adjusted in the applicable account, staff, customer, or facility settings. You may also opt out of marketing text messages by replying STOP, QUIT, END, REVOKE, OPT OUT, CANCEL, UNSUBSCRIBE, or another provided opt-out keyword where supported, or by contacting us at help@atlantiscontrolsystems.com.

Atlantis will treat any reasonable request to stop marketing texts as an opt-out where required by law, even if the request does not use the exact automated keyword. If a texting method does not support replies, Atlantis will provide another reasonable opt-out method in the message where required.

If you ask Atlantis not to contact you for marketing, we may retain enough information to honor that request, maintain suppression lists, and comply with law. Opting out of marketing does not prevent Atlantis from contacting you about safety, security, billing, warranty, service, legal, account, or transactional matters.

9. Children and Account Eligibility

The Services are intended for adults, businesses, marinas, dealers, installers, and boat lift users operating under appropriate supervision. The Services are not directed to children under 13, and Atlantis does not knowingly collect personal information from children under 13. If you believe a child under 13 has provided personal information, contact us so we can review and delete the information where required.

10. Data Retention

We retain personal information and device-related information for as long as reasonably necessary for the purposes described in this Policy, including to provide the Services, maintain accounts, support devices, administer subscriptions, honor warranty and service obligations, maintain safety and audit records, resolve disputes, comply with law, and enforce agreements.

Retention periods vary by record type. For example, warranty, installation, safety, billing, transaction, service, and legal records may be retained longer than routine website analytics. We may anonymize, aggregate, or delete information when it is no longer reasonably needed.

11. Security

We use commercially reasonable administrative, technical, and physical safeguards designed to protect personal information against unauthorized access, disclosure, alteration, and misuse. These safeguards may include encryption in transit, access controls, authentication controls, logging, backups, vendor controls, and operational security procedures.

No system is perfectly secure. You are responsible for maintaining the confidentiality of your account credentials, using strong passwords, restricting access to authorized operators, and promptly notifying Atlantis of suspected unauthorized access or unsafe device behavior.

12. Your Privacy Choices

Depending on your location and the nature of your relationship with Atlantis, you may request access to, correction of, deletion of, or a copy of personal information associated with you. You may also request to opt out of sale, sharing, targeted advertising, or applicable profiling, opt out of marketing emails or marketing text messages through the methods described in this Policy, and adjust available system email or text-message preferences in the applicable account, staff, customer, or facility settings.

We may need to verify your identity and authority before acting on a request. An authorized agent may submit a request on your behalf where permitted by law, but Atlantis may require proof of authorization and may ask you to verify your identity directly.

We may decline or limit a request where permitted by law, including when retaining information is necessary for safety, security, warranty, billing, legal compliance, dispute resolution, product operation, fraud prevention, or another lawful business purpose. If a privacy law gives you an appeal right, you may appeal our decision by replying to our response or contacting us at the address below.

Atlantis will not unlawfully discriminate against you for exercising privacy rights. Some Services may require certain information to operate, support connected products, process payments, maintain safety records, or satisfy warranty and legal obligations.

13. State Privacy and Florida Notices

Atlantis is based in the United States and provides services to Florida residents and customers in other states. Florida law requires covered entities to take reasonable measures to protect personal information and to provide required notices after certain security breaches. Atlantis maintains processes intended to support those obligations.

The Florida Digital Bill of Rights applies only to certain large businesses and platforms that meet statutory thresholds. Even where that law does not apply to Atlantis, this Policy is intended to clearly describe the categories of personal information we process, the purposes of processing, the categories of third parties involved, and ways to contact us about privacy requests.

14. International Use

Atlantis is based in the United States. If you access or use the Services from outside the United States, your information may be transferred to, processed, and stored in the United States and other jurisdictions where Atlantis or its service providers operate. Those jurisdictions may have data protection laws that differ from the laws where you live.

15. Changes to This Policy

We may update this Privacy Policy from time to time. When we make material changes, we will update the "Last updated" date and may provide additional notice where appropriate. Continued use of the Services after an updated Policy becomes effective means the updated Policy applies to your use of the Services after that date.
